1. Who we are

useprison.com (the "Site") is operated by Prision International Streetwear LLC, a Florida limited liability company doing business as PRISON® ("PRISON," "we," "us," or "our"), 7345 W Sand Lake Rd, Ste 210, OF 9798, Orlando, FL 32819, United States. These Terms of Service ("Terms") govern your access to and use of the Site and any purchase you make through it. By using the Site or placing an order, you agree to these Terms, our Privacy Policy, our Shipping Policy and our Return & Refund Policy, which are part of these Terms. If you don't agree, please don't use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. If you are under 18, you may use the Site only with the involvement of a parent or legal guardian. By ordering, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Products, pricing and availability

All prices are in US dollars and exclude shipping and applicable sales tax, which are shown at checkout before you pay. We may change prices, products and availability at any time without notice. We work hard to display our pieces accurately, but colors, textures and fit can look slightly different on your screen. We may limit quantities per order, per person or per household, and we may discontinue any product at any time.

If a product is listed at an incorrect price or with incorrect information because of a typographical or system error, we may cancel the affected order, even after it has been confirmed, and refund any amount charged.

4. Orders and payment

Your order is an offer to buy. We may accept or decline it at our discretion, including for suspected fraud, pricing errors, stock issues or violations of these Terms. An order is accepted only when we ship it; the order confirmation email is not acceptance. If we cancel an order after payment, you receive a full refund to the original payment method.

We accept the payment methods shown at checkout. You authorize us and our payment processors to charge the total amount of your order to the payment method you provide. You are responsible for keeping your billing and shipping information current. We may request additional verification before accepting an order.

5. Shipping, returns and refunds

Shipping options, costs, delivery estimates and what happens with lost or damaged packages are described in our Shipping Policy. Returns, exchanges and refunds follow our Return & Refund Policy. Risk of loss and title for products pass to you when we hand the package to the carrier, except as stated in the Shipping Policy.

6. Promotions, discount codes and gift cards

Promotions and discount codes are valid for the period and conditions stated with the offer. Unless the offer says otherwise, one discount code can be applied per order, codes can't be combined, have no cash value and can't be applied to previous orders. Gift cards are not redeemable for cash except where required by law. We may cancel or modify any promotion at any time and may void discounts obtained through misuse.

7. Accounts

You can shop as a guest or create an account. You are responsible for keeping your login details confidential and for all activity under your account. Tell us immediately at useprison@useprison.com if you suspect unauthorized use. We may suspend or close accounts that violate these Terms.

8. Intellectual property

The PRISON® name and logo, our designs, graphics, photographs, product names, text, videos and all other content on the Site are owned by or licensed to us and are protected by US and international trademark, copyright and other intellectual property laws. You may browse the Site and share links to it for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, sell, or create derivative works from our content, designs or trademarks without our prior written permission. Third-party names and marks that appear on the Site belong to their respective owners.

9. Reviews, comments and other content you submit

If you submit reviews, comments, photos, suggestions or other content ("Submissions"), you grant us a non-exclusive, royalty-free, perpetual, worldwide license to use, reproduce, edit, publish and display them in any media, including for marketing, and to use the name you submit with them. You confirm that your Submissions are your own, don't infringe anyone's rights, and are not false, defamatory, obscene, abusive or unlawful. We may edit, remove or refuse any Submission at our discretion.

10. Acceptable use

You agree not to use the Site for any unlawful purpose; to infringe our or anyone else's intellectual property or privacy; to transmit viruses or malicious code; to scrape, crawl or harvest data; to interfere with the Site's security or operation; to place fraudulent orders or use stolen payment methods; or to resell our products as an unauthorized dealer. We may restrict or terminate your access for violating these Terms.

11. Third-party links and services

The Site may contain links to third-party websites or services (for example, payment providers, carriers or social media). We don't control them and are not responsible for their content, policies or practices. Your use of them is at your own risk and subject to their terms.

12. Disclaimer of warranties

The Site and its content are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the Site will be uninterrupted, error-free or secure, or that information on it is always accurate or complete. Nothing in these Terms limits any warranty or right that can't be excluded under applicable law, including your rights under our Return & Refund Policy.

13. Limitation of liability

To the fullest extent permitted by law, PRISON, its owners, employees, contractors and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising out of or related to your use of the Site or products, even if we have been advised of the possibility of such damages. Our total liability for any claim related to an order is limited to the amount you paid for that order. Some states don't allow the exclusion or limitation of certain damages, so some of the above may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless PRISON and its owners, employees and affiliates from any claim, loss, liability or expense (including reasonable attorneys' fees) arising from your breach of these Terms, your Submissions, or your misuse of the Site.

15. Governing law and disputes

These Terms and any dispute arising out of or relating to them, the Site or any order are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at useprison@useprison.com so we can try to resolve the issue informally within 30 days. If we can't, any claim must be brought in the state or federal courts located in Orange County, Florida, and you consent to their jurisdiction, unless applicable law gives you the right to bring the claim elsewhere. Each party waives any right to a jury trial to the extent permitted by law.

16. Changes to the Site and these Terms

We may update the Site and these Terms at any time. Changes take effect when posted, with the "Last updated" date revised above. Your continued use of the Site after changes are posted means you accept them. Orders are governed by the Terms in effect when the order was placed.

17. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with the policies referenced in Section 1, are the entire agreement between you and PRISON regarding the Site and replace any prior agreements. You may not assign your rights under these Terms; we may assign ours to an affiliate or successor.
